First SDAU development approval granted

A client of Lavan, being Clean Energy Fuels Australia, has successfully obtained the first development approval to be granted pursuant to the State Development Assessment Unit (SDAU) pathway under the new Part 17 of the Planning and Development Act 2005 (WA).  The development approval was granted at the Western Australian Planning Commission meeting on 5 November 2020.

The development in question is a proposed $50 million liquified natural gas processing facility in the Shire of Mount Magnet.  The proposal will generate significant levels of new employment in the regions, both directly and indirectly.

Lavan is pleased to have advised the proponent of this development through the SDAU process (including by providing a legal deputation in support of the proposal) and to be part of this historic planning decision.

The SDAU provides for an invaluable assessment pathway for significant development applications, especially where there are complicated factors at play that may place doubt upon the prospects of achieving a successful outcome before a Development Assessment Panel or a local government Council.
