Bans on individuals at licensed premises

Recently there have been media reports regarding police action to ban persons from being present on licensed premises. This action is made possible by the new provisions in the Liquor Control Act which allow the police to apply for a prohibition order in respect of a particular person to prohibit that person from being employed by a licensee or from entering licensed premises.

Although evidence is required to be produced by the police in support of such an application, that evidence may potentially be treated as confidential under the Act and withheld from the person in question.  

If a licensee receives a copy of an order prohibiting an individual from being on the licensee's premises, the failure to comply is an offence which can attract a penalty of up to $10,000.
