Compliance obligations during the festive season

With the festive season fast approaching, licensees are reminded of their many compliance obligations under the Liquor Control Act 1988.

The Liquor Enforcement Unit has been particularly active in recent months issuing infringement notices and section 95 complaints against various licensees in Rockingham, Kwinana, Fremantle and Subiaco amongst other places.  The majority of complaints stem from issues relating to responsible service.
 
In our experience, from carrying out our friendly ‘Lawdits’ on licensed premises, we have identified the following most common areas of non-compliance:

  1. displaying all pages of the current liquor licence in a conspicuous position within their premises;

  2. keeping the approved plans on the licensed premises at all times and available for inspection by an authorised officer;

  3. maintaining an up-to-date incident register in the current form approved by the Director;

  4. maintaining a training register;

  5. ensuring an approved manager is on duty at all times liquor is served or failing that, clearly appointing a substitute manager for short periods of absence; and

  6. publicly displaying the harm minimisation policies.
