Charmaine Tsang, a partner in the Employment and Safety team at Lavan, is a highly experienced adviser on workplace and industrial relations matters covering industrial disputes, enterprise agreements, drafting policies and developing industrial relations strategies. She represents clients in the resources, construction and engineering sectors, as well as in commercial and professional services.
Charmaine is experienced in conducting investigations of misconduct, discrimination, harassment and workplace bullying and works with clients on claims of unfair dismissal, adverse action, discrimination, corruption issues, breach of contract and disputes under enterprise agreements, and developing appropriate responses to complaints and investigations by the Fair Work Ombudsman and other regulatory agencies. She provides court and tribunal representation for her clients.
Charmaine advises clients on recruitment, selection, performance management, work practice changes, misconduct matters, termination of employment, confidentiality and post termination restraints.
She provides ongoing training to human resources practitioners in all areas of employment law and human resources, as well as training to managers and executives around their statutory obligations in the anti-bribery and corruption space and obligations under the occupational and health safety legislation, and is an accredited mediator under the National Mediator Accreditation System.
Prior to commencing with Lavan, Charmaine headed up the Workplace Relations practice of a national law firm after working in-house at an ASX100 engineering, asset management and maintenance services company. Charmaine’s responsibilities included providing legal advice and representation on employee relations and human resources activities across the sectors of oil and gas, mining, rail, transport & technology systems, power, water, property, infrastructure and defence.
Charmaine is fluent in conversational Cantonese.
