Lavan's Construction and Infrastructure team provides advice that is practical and commercially relevant. We are sensitive to the needs of our clients, the importance of preserving our clients’ commercial relationships (where possible) and providing solutions rather than entrenching disputes.
We pride ourselves on knowing the local construction industry, the contracts in use and the issues arising in carrying out construction works.
Our team members are active participants in construction industry associations including the Australian Institute of Building, Civil Contractors Federation, the Institute of Arbitrators and Mediators Australia and the Resolution Institute. We have well established relationships with expert programmers, quantity surveyors, project managers and other consultants.
Our team work with contractors, often in association with programmers, quantity surveyors and other consultants, to develop claims and provide strategic advice about claims presentation.
The Lavan Construction and Infrastructure team will assist with the preparation of model notices and procedures and advise on issues arising during the works including recourse to security, variations, EOTs, prolongation costs, liquidated damages, payment disputes, time bars and termination.
Our team draft, review and negotiate construction contracts, consultancy agreements and subcontracts. We provide advice on appropriate forms of contracts including construct only, design and construct, construction management, early contractor involvement, EPCM and PPP.
We will negotiate a range of contracts on your behalf, deal with relevant authorities and draft documents that are clear, concise and all-inclusive. Plain English contracts are our strength.
Disputes arising at any stage of your project are dealt with promptly and effectively by our experienced team. We act in all forms of dispute resolution used in the construction industry including security of payment adjudication applications under the Construction Contracts Act, expert determination, mediation, arbitration and litigation.
We act for all parties in the construction process, including principals, contractors, subcontractors, developers and suppliers.
Our team frequently present training seminars and courses to our clients in relation to construction law and effective contract administration and management.
Our team present bi-annual Construction Industry Seminars to our clients on topical issues impacting construction law and the industry. Click here to learn more about past seminars.
