Lavan acted for an NDIS provider undertaking the acquisition of another provider’s NDIS‑funded operations, including Supported Independent Living, community access services, therapy supports and related accommodation arrangements. The transaction required detailed analysis of the target’s NDIS registrations, service agreements, residency leases, grant funding agreements and operational contracts. Our team conducted a comprehensive due diligence review, identifying regulatory, contractual and workforce risks and mapping the steps required to transition services and participants safely.
Lavan supported a Specialist Disability Accommodation (SDA) developer establishing a new SDA project, advising on eligibility requirements under the NDIS (SDA) Rules, participant categories, design standards, and compliance across the development lifecycle. We prepared the full suite of SDA tenancy and accommodation agreements, advised on funder and investor arrangements, resolved zoning and planning considerations, and ensured the project structure aligned with NDIS registration requirements. Lavan also provided guidance on operational policies, incident and complaints processes, participant transitions and risk allocation with SIL providers.
