Our leasing practice represents major landlords and tenants throughout the State. We negotiate and prepare all types of specially tailored lease agreements and provide practical advice and solutions. Our advice covers all areas of law relating to leasing including rent reviews, incentives, tenant and landlord works, defaults, end of lease obligations and statutory compliance. We provide clear and concise documentation.
We pride ourselves on being available at the earliest stages of projects to provide assistance in the structuring of transactions that can deliver flexibility, minimise risk, and address duty and tax issues early on to minimise the financial impacts of these issues on property projects. We have a long track record for acting for syndicators in the buying and selling of assets. In addition to undertaking the due diligence required with respect to the purchase of an asset for a syndicate, we also advise on compliance issues in relation to public disclosure documents; advise on compliance with the syndicator’s Australian Financial Services licence; advise on, and implement, the acquisition strategy; draft all of the documentation required for the transaction; advise on the financing for the transaction, including the hedging arrangements that are often required by financiers; and provide duty, CGT and GST advice for the transaction. The due diligence enquiries invariably require us to undertake extensive lease, title, property and planning due diligence due diligence.
