Due to growth of the Australian business and the demand for products and services, our client reached the stage where they required a management position in the region for the business to run effectively and to support their strategic growth plans. However, they were unable to source an appropriately skilled Australian worker due to the highly skilled and specific nature of the role.
Lavan assisted our client to facilitate an intra-company transfer from their associated entity company overseas. As part of the process, we prepared their Standard Business Sponsorship, Nomination Application and Visa application. With all applications approved, we delivered a positive and timely result for the client, who had been under significant pressure due to the vacancy of the management position and its potential impact on their service standards.

Our client agreed to sponsor one of their trade workers but inadvertently employed a migrant worker for 4 months and 19 days after his Subclass 408 visa had expired. Once the issue was identified, we assisted the client to act immediately. The worker ceased work, applied for a Bridging Visa E to regularise his immigration status and subsequently departed Australia. We supported the client in implementing post-compliance procedures to ensure future adherence to immigration requirements.
Once the nominee was offshore, we assisted the client to prepare a Subclass 186 nomination for the role and addressed their inadvertent breach. We also assisted the visa applicant to prepare and lodge a 186 visa application to facilitate his return to Australia. By recommending a Subclass 186 visa which is a permanent residence visa, the visa applicant was able to avoid a “visa grant ban” which he would have been subject to on a temporary visa. A positive outcome for both the client and the applicant, with all applications approved.
